An Atlanta arrest does not create one universal record. Atlanta Police may hold the incident or arrest report, a city or county detention facility may hold the custody record, and a different court may hold the criminal case.

The location matters too. Atlanta lies in both Fulton and DeKalb counties, and airport arrests can follow a different custody route. This guide puts the official search rules, report fees, court-copy costs, bond steps, criminal-history requirements and record-restriction process in one place.

Do not equate an arrest with a conviction. A police report records allegations and investigative information; a jail record records custody; and a court record shows what was actually filed and how the case progressed. Confirm identity and final disposition before relying on an Atlanta arrest record.

Atlanta Police itself directs people to different facilities depending on the arrest. Do not assume that every APD arrest goes to Fulton County Jail.

Three-business-day rule

APD says available records will be provided within three business days. When the request requires a custom report, significant review or redaction, the response within that period may instead provide an estimated completion time and estimated cost.

Complex requests can take much longer. APD’s current records-response template notes that some requests requiring a diligent search and redaction may be estimated at roughly three to four weeks. That is an estimate, not a guaranteed deadline.

Pending criminal investigations

Do not expect the entire investigative file while a case is pending. APD’s current response guidance states that for cases pending investigation and/or adjudication, material other than the initial incident report may be exempt from disclosure under Georgia law.

Where to request an Atlanta booking photo or mugshot

APD’s Open Records Unit lists mugshots among records it does not provide through that unit. If the person was booked into Fulton County custody, a booking photograph may instead be a Sheriff’s Office record.

If the arrest went to DeKalb, Clayton or another agency, request the photograph from that booking agency rather than APD Open Records.

  • The office may charge the hourly rate of the lowest-paid qualified employee for additional search, redaction and compilation work.
  • Ordinary copies are generally $0.10 per page unless another law applies.
  • Fulton states that there is no charge for producing 10 pages or fewer.
  • Certified or specialized records can have higher charges.
  • An estimated cost is provided before production when charges apply.

How to determine whether a city case requires appearance

Find the case Use the court’s Find My Case function and verify the defendant/citation information.
Check the court date The citation itself is the official summons, but the online case can be used to confirm the scheduled event.
Check payment eligibility Some citations can be resolved through online payment without an appearance, but the court specifically warns that not every case is eligible.
Request a reset early The court says a request to change the arraignment date must be submitted no later than 10 days before the arraignment.

Cash-bond refund rules

  • Fines, fees and court costs may be deducted from a cash bond when the surety authorizes it.
  • The remaining balance can be refunded to the surety who posted the bond.
  • If the case is bound over to a higher court, the bond transfers with the case to the appropriate jurisdiction.
  • The court warns that unclaimed cash bail is subject to statutory time limits; it should not be left unresolved indefinitely.

How to search the Fulton County case after an Atlanta arrest

The Fulton County Clerk provides separate search paths for Magistrate/State judicial records and Superior Court records.

Use a court case number when available This is safer than searching only a common name.
Otherwise search by the defendant’s legal name Compare middle name, suffix and case dates carefully.
Identify the court level A preliminary Magistrate matter may later become a State or Superior Court prosecution.
Find the filed accusation or indictment Compare it with the original jail charge. They do not always match.

When an Atlanta-only arrest search is not enough

A Georgia criminal-history record can include identification data, arresting agency, arrest date, charges, final judicial disposition submitted by the court or prosecutor, and custodial information when the person was incarcerated in a Georgia correctional facility.

Fingerprint-based Georgia check

For qualifying employment, licensing and other non-criminal-justice fingerprint checks, Georgia uses the Georgia Applicant Processing Service (GAPS). GBI states that the current vendor is IdentoGO and that results are generally available to the authorized requesting agency within approximately 24–48 hours after fingerprints and the transaction are submitted.

Do not use a local booking search as a statewide background check. A jail database only shows custody within that system and is not a substitute for a Georgia criminal-history record.

How to restrict an Atlanta arrest record under Georgia law

Georgia uses the term “record restriction.” Restriction limits disclosure of qualifying arrest information for non-criminal-justice purposes. It is not the same as pretending the arrest never existed for every governmental purpose.

Pre-July 2013 three-part application path

Do not skip the GBI date rule. APD’s service page still publishes its Identification Unit mailing requirements, while GBI’s statewide guidance says post-July 1, 2013 arrests begin with the prosecutor rather than the older arresting-agency application. Use the arrest date to choose the correct path.

What happens after an arrestee reaches Fulton County Jail?

First appearance Fulton states that arrestees who do not bond out ordinarily appear before a judge within 24 hours. Arrests on Saturday or Sunday are generally seen by a judge Monday under the county’s published process.
Fresh bond information can lag. Fulton says Booking receives first-appearance results from the Clerk at approximately 4 p.m. each day. If you call for bond information immediately after court, the jail record may not yet reflect the new order.

Picking up someone else’s property

APD requires a notarized authorization letter containing the owner’s name, recipient’s name and a complete description of the property, plus the recipient’s valid picture identification.

Evidence is different from ordinary property

A case disposition alone is not enough. APD says evidence cannot be released unless the arresting officer changes its status to property or the claimant presents a specific Court Order to Release Property.

Firearm release
